Terms & Conditions
The terms on which this website, its catalogue and its enquiry forms are made available to you.
This is a catalogue and an enquiry desk, not a shop. Specifications are a guide, quotations are what bind us, and disputes go to the courts at Aligarh.
1 Agreeing to these terms
This website is operated by A R Enterprises, trading as Gusto Locks. By opening it, browsing the range, downloading a catalogue or sending us an enquiry, you accept these terms in full.
If you do not accept them, please do not use the site. In these terms “we”, “us” and “our” mean A R Enterprises, and “you” means the person or the business using the site.
2 What this website is for
We manufacture padlocks at Koil, Aligarh. This site exists to show what we make, to describe how it is made and tested, and to let dealers, distributors, OEM buyers, institutional buyers and exporters get in touch.
It is a catalogue and an enquiry desk. It is not a shop: there is no checkout, no price list and no facility to place an order or make a payment through these pages. Nothing on the site is an offer to sell. An enquiry you send is an invitation for us to quote, and a sale exists only once we confirm it in writing.
3 How you may use the site
You may read the site, print or save pages, and pass the catalogue on within your own business, for the purpose of assessing our products and trading with us. That permission is given for your internal commercial use and nothing more.
You may not resell the material, publish it as your own, or present our products as the output of another works.
4 What you must not do
You must not:
- use the site for any unlawful, fraudulent or deceptive purpose;
- attempt to gain access to any part of the site, its server or its database that has not been made available to you;
- probe, scan or test the site for vulnerabilities, or defeat any security or access control on it, including the form that gates a download;
- upload or transmit any virus, worm, malicious code or anything designed to interfere with the site;
- use a robot, scraper or other automated means to harvest the product data, the images or the contact details on the site;
- send a false or impersonated enquiry, or submit somebody else’s contact details as your own;
- overload the site with requests, or do anything that degrades it for other visitors.
We may refuse or withdraw access to anyone who does these things, and report them where the law requires.
5 Product information, specifications and images
The descriptions, dimensions, weights, finishes, material grades, lever counts, key differs and test figures on this site are given in good faith and are correct to the best of our knowledge at the time of publication. They are for general guidance.
They are not a warranty and they do not form part of a contract. Photographs are illustrative: finishes vary between batches, screens render colour differently, and a photograph may show an accessory that is not part of the article. Dimensions carry normal manufacturing tolerance.
We improve the range continuously, and we may change a specification, a component or a finish without notice. If a particular dimension, tolerance, grade or test result matters to you, ask us to confirm it in writing before you order, and rely on that confirmation rather than on this website.
6 What a padlock can and cannot do
A padlock is a deterrent. No lock, ours included, is impossible to defeat given enough time, force and equipment, and nothing on this site should be read as a promise that a particular product will prevent theft, forced entry or loss in any particular situation.
Choosing the right lock for a door, a shutter, a gate, a godown or a container, fitting it correctly, using a hasp and staple of matching strength, and looking after the keys are all matters for you or your fitter. Where a specific standard, certification or insurance requirement applies to your use, check with us in writing that the model you have chosen meets it.
Keys and key numbers should be kept secure. We cannot be held responsible for loss arising from keys that were copied, mislaid or passed to somebody who should not have had them.
7 Availability of the range
Products shown here are subject to availability. Listing a model does not mean it is in stock, in current production, or available in every size, finish or packing shown.
We may add a model, withdraw one, or change the range at any time, and we are not obliged to continue making anything that appears on this site.
8 The catalogue and downloadable files
The catalogue and other files offered for download are provided for information. Some of them ask for your name and contact details before they open, and those details are handled as described in our privacy policy.
Downloading a catalogue, a price sheet or a specification does not create a business relationship. It does not appoint you as a dealer, distributor or agent, it does not give you any exclusivity in a territory, and it does not entitle you to represent yourself as connected with us.
A catalogue is current only as at its edition date. Superseded editions should not be relied on.
9 Quotations, prices and orders
Any price, discount, lead time, minimum order quantity, packing or payment term mentioned in correspondence is indicative until we confirm it in a written quotation or a pro forma invoice. Such a confirmation is valid for the period stated on it, and if no period is stated, for 15 days.
Prices depend on the cost of brass, steel and other inputs, on freight and on statutory levies, all of which move. Unless the quotation says otherwise, prices are exclusive of GST and other taxes, duties and freight, which are charged at the rate applying on the date of invoice.
An order binds us only once we have accepted it in writing. Where a signed purchase order, quotation, supply agreement or distribution agreement between us says something different from this website, that document governs the sale and these terms govern only your use of the site.
10 Dealer, distributor, OEM and export enquiries
Sending a dealership, distribution, OEM or export enquiry does not guarantee that it will be accepted. We appoint dealers and distributors at our discretion, having regard to territory, existing appointments, volume and creditworthiness, and we are not obliged to give reasons for a decision.
Where you tell us about your firm, your turnover or your territory in support of an application, you confirm that what you have told us is true. An appointment obtained on the strength of a false statement may be withdrawn.
If you buy for export, it is your responsibility to comply with the export, import, customs, labelling, marking and product-standard rules of India and of the destination country, and to hold any licence or registration those rules require. We do not warrant that a product is approved for sale or lawful to import in any country outside India.
11 Intellectual property
Everything on this site belongs to us or to the people who licensed it to us: the text, the photographs, the drawings and exploded views, the product designs and codes, the catalogue, the page layouts, the code behind them, and the Gusto Locks name, logo and get-up.
You may not copy, reproduce, modify, republish, distribute or use any of it for a commercial purpose without our written permission, beyond the internal use allowed in section 3. You may not remove or obscure any notice of ownership, and you may not use our name, our logo or our product photographs to sell a product that is not ours.
Counterfeiting our products or our packaging, and passing goods off as ours, will be pursued under the Trade Marks Act, 1999, the Copyright Act, 1957, the Designs Act, 2000 and every other remedy available to us.
12 Material you send us
When you send an enquiry, a drawing or a specification, you confirm that it is yours to send and that sending it to us breaches nobody else’s rights. You give us permission to use it for the purpose of answering you, quoting and, if it comes to it, manufacturing for you.
We treat commercially sensitive enquiries as confidential, as described in our privacy policy. If you need a formal confidentiality agreement before sharing a design, ask for one before you send it.
13 Links to other sites
Where this site links to another website or loads a service run by somebody else, such as a map, a video or a messaging app, the link is offered for convenience. We do not control those sites, we do not endorse them, and we are not responsible for their content, their accuracy or what they do with your data. Their own terms and privacy policies apply once you leave us.
14 Disclaimer
The site and its content are provided as they are. While we take reasonable care to keep the information correct and current, we do not warrant that it is complete, accurate or free of error, nor that the site will be available without interruption, that it will be free of viruses, or that any fault in it will be corrected.
Access may be suspended or withdrawn at any time, for maintenance or for any other reason, without notice and without liability.
15 Limitation of liability
To the fullest extent the law allows, we are not liable for any loss or damage arising from your use of this site or from your reliance on anything published on it, including loss of profit, loss of business, loss of contracts, loss of goodwill, loss of anticipated savings, or any indirect or consequential loss, however it arises.
Where liability cannot be excluded, our total liability in connection with this website is limited to the amount you have paid us, if anything, for the transaction the claim relates to.
Nothing in these terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded. Nothing in this section affects the rights a consumer has under the Consumer Protection Act, 2019, or any statutory warranty that applies to goods actually sold.
16 Indemnity
You agree to indemnify us against any claim, loss, damage, cost or expense, including reasonable legal fees, arising out of your breach of these terms, your misuse of the site, or any material you send us that turns out to infringe somebody else’s rights.
17 Privacy
What we do with the details you send through this site is set out in our Privacy Policy, which forms part of these terms. Please read it.
18 If part of these terms fails
If any provision of these terms is found by a court to be unlawful or unenforceable, that provision is severed and the rest continues in force. If we do not enforce a right on one occasion, that is not a waiver of it on another.
19 Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them or with your use of this website, are governed by the laws of India.
The courts at Aligarh, Uttar Pradesh, India shall have exclusive jurisdiction.
20 Changes to these terms
We may amend these terms at any time by publishing a revised version on this page, and the date at the top will change with it. The version published here at the time you use the site is the one that binds you, so please look at it again from time to time.
Questions about these terms
Ask before you order rather than after. We would rather put something in writing than have it turn on an interpretation later.
